August 3 FOLA Real Estate Update

During the busy real estate season, it’s easy to miss important updates and changes. Thank you to the Federation of Ontario Law Associations for sharing this.

New condo corporation and condominium bylaw statements were added to Teraview, details available here. As well, the Planning Act is ready for comments until August 23, read the details here.

September 30: National Day for Truth and Reconciliation

September 30 has been declared as a general holiday under the Canada Labour Code. The National Day for Truth and Reconciliation will be observed to honour First Nations, Inuit and Métis survivors and their families and communities, and ensure the public commemoration of their history and the legacy of residential schools.

This new holiday applies to federally regulated employers, including banks. However, it will not affect the Land Registry Office or Teraview operations on September 30 unless the provincial government passes similar legislation.  See the latest bulletin from the Director of Titles here confirming that Teraview and the LRO will be open on September 30.

Many banks have already confirmed to their customers that they will be closed on September 30, 2021.

Don’t get caught trying to make last minute arrangements – review your closing list now to address any transactions scheduled to close on September 30.

Planning Act - further proposed amendments

Following the recent amendments to the Planning Act (which have not yet been proclaimed into force), the provincial government is accepting comments on proposed complementary and consequential amendments to the regulations under the Planning ActDetails are available here.

Comments to the Ministry of Municipal Affairs and Housing are due by August 23, 2021.

New Teraview Statements

On June 19, 2021, new statements were added for the registration or deletion of a condominium bylaw or change of address for service for a condominium corporation. More details are available here.
